ان يكون نشـــاط المشـــروع من ضمن مشـــاريع ومجـــالات البنية التحتية المشـــمولة بقانون الاســـتثمار رقم )3( لســـنة 2025م.
أن يكـــون المســـتثمر حاصل على عقد شـــراكة ســـاري الصلاحية مـــع الجهة الحكوميـــة المختصـــة، بصيغة معتمدة مثـــل )- BOT BOOT )أو غيرهـــا من صيغ الشـــراكة.
ألا يكون المشـــروع قد حصـــل على مزايا أو حوافـــز من خلال عقد الشـــراكة تتجاوز أو تعادل المزايا المقررة وفق قانون الاســـتثمار.
